Do I Need to See the Company Doctor?

If you are injured on the job, your employer and its insurance carrier will control which doctor you see for your workers' compensation claim. If you go to your own physician, your employer may not pay for your medical treatment. Covered medical care must be provided by an authorized doctor and be directly related to your work injury.

Many injured workers do not agree with the company doctor's assessment of their injuries and ability to return to work. When this occurs, it is a good idea to consult with a lawyer. At the Law Office of Donald D. Zuccarello, we have represented thousands of injured Tennessee workers throughout the workers' comp claims process. We can ensure that your rights are protected and that you receive fair compensation for your injury.

We Can Help You Challenge the Treating Physician's Rating

If your workers' comp claim is accepted, you are required to see an authorized treating or panel physician. This means you will select a doctor from a panel of three or more doctors provided by your employer's insurance carrier.

If you do not like the doctor you are sent to, you have an opportunity to get an independent medical evaluation (IME) from a doctor not affiliated with the panel of physicians. However, your employer will still get to select the doctor providing the IME. You may choose to see your own doctor, but it will be at your expense. Only treatment provided by an authorized treating physicians will be covered by workers' comp. Additionally, your own doctor's diagnosis and prognosis will not be considered in determining your impairment rating.

Our legal team can cross-examine any company or insurance carrier physicians and their given diagnosis. We will make certain that the true extent of your injuries comes to light in court so you can get the best medical coverage to meet your needs.
