Experienced Legal Counsel Can Make the Difference
Because most workers' compensation claims are initially denied, many injured workers must go through an administrative hearing process to obtain benefits. The Tennessee Department of Labor has jurisdiction of the claim through the Benefit Review Conference process. If the claim cannot be settled or resolved through this administrative process, you can take the case to the court of proper jurisdiction: chancery or circuit court.
To ensure that your rights to collect workers' compensation benefits are protected, speak with an attorney. The Law Office of Donald D. Zuccarello can help you request a Benefit Review Conference and appeal your case in court, if necessary. Appealing Your Workers' Comp Claim
In Tennessee, the Benefit Review Conference is an informal dispute resolution proceeding used to resolve workers' compensation disputes. It is an administrative process, not a trial. You may choose to have an attorney represent you throughout this process.
In most cases, a Benefit Review Conference cannot be scheduled until the injured worker has reached maximum medical improvement (MMI) as determined by the treating doctor. If the parties cannot reach an agreement on a mediated settlement through this process, the Workers' Compensation Specialist in charge of the case may declare an impasse. At this point, the administrative process will have been exhausted and you may take your case to court.
When a workers' comp case proceeds to court, it is no longer an informal dispute resolution, but an adversarial trial. Our experienced trial lawyers can represent you in court.
